FlippX Inc. ("FlippX," "we," "our," or "us") operates the FlippX platform, which includes the FlippX mobile application, website, and all affiliated digital properties, including social media pages (collectively referred to as the "Platform").

At FlippX, we take your privacy and the protection of your personal information seriously. This Privacy Policy (the "Policy") describes the types of information we collect from individuals who access or use the Platform, how we use and share that information, and the choices you have regarding your information.

In some cases, we may allow users to voluntarily submit facial images or related data for the creation of avatars ("Avatars") within the Platform. Biometric Data may be:

• Processed to personalize user avatars and enhance in-app interaction
• Stored securely and never shared with third parties without consent

2. Personal Data

To participate in contests and access certain features on the FlippX Platform, you will be required to register for an account and submit personal information (hereinafter referred to as "Personal Data").

We collect and use this Personal Data for the following purposes:

• To create and manage your user account
• To verify your eligibility and identity for accessing and participating in contests
• To deliver requested services and features
• To provide technical support and respond to inquiries
• To send transactional, legal, and promotional communications
• To detect, investigate, and prevent fraudulent activity

By submitting your Personal Data to FlippX—whether directly at our request or voluntarily through interactions such as comments or social engagement—you consent to the collection, use, processing, and potential disclosure of such data as outlined in this Policy.

3. Biometric Data

We may offer users the ability to personalize their experience within the Platform by creating custom avatars using facial recognition or similar tools. This may involve the collection and processing of Biometric Data, such as:

• Photographs
• Facial scans
• Expression patterns

This data is used exclusively for avatar creation and in-app personalization and is never used for advertising, data resale, or any purpose outside of the FlippX Platform. Submission of Biometric Data is entirely optional, and all users may access avatar customization features without providing facial data.

Legal Basis: Your explicit prior consent is the lawful basis for any collection or processing of Biometric Data.

FlippX does not store or retain Biometric Data on its servers. Instead, where applicable, we may partner with third-party service providers to facilitate avatar creation. These providers are contractually required to:

• Process Biometric Data solely for avatar generation
• Adhere to strict data protection standards
• Refrain from storing, selling, or reusing Biometric Data for any other purpose

4. Device Information & Usage Data

Regardless of whether you submit Personal or Biometric Data, we may automatically collect certain technical data when you interact with our Platform. This includes both Device Information and Usage Data, which may involve:

• IP addresses
• Device identifiers (e.g., IDFA, Android Advertising ID)
• Browser type and version
• Operating system and platform
• General location (city/state)
• In-app activity logs and engagement metrics
• Crash reports and diagnostic logs

This data is used to:

• Improve platform performance and reliability
• Monitor app usage trends and analyze engagement
• Detect bugs or technical issues
• Conduct research and user behavior analysis
• Develop content and features based on user interests
• Protect against misuse and enhance platform security

Data may be aggregated and anonymized for analytical or operational purposes and will not be used to personally identify you unless combined with other identifiable information.

5. Information Shared with or Received from Social Networks

If you link your FlippX account to a third-party platform (a "Social Network") such as Facebook, Instagram, or X (formerly Twitter), we may collect the following information from your social profile:

• Full name
• Email address
• Social username
• Profile photo
• Public connections or friend lists (if authorized)

Additionally, the Platform may include features that allow you to "Like," "Share," or post activity to your Social Network. By using these features:

• You authorize FlippX to send and receive information from the linked Social Network
• You understand that your social activity may be visible to others based on your settings on that platform

6. Sharing of Information

We take your privacy seriously. We do not sell, rent, trade, or disclose your Personal Data to third parties for their direct marketing purposes under any circumstances.

However, there are limited circumstances in which we may share your Information, including Personal Data and Usage Data, as follows:

6.1 Legal Compliance and Protection of Rights

We may disclose your Information if we are legally required to do so, including but not limited to:

• Responding to subpoenas, court orders, or other legal processes;
• Complying with regulatory inquiries or government investigations;
• Asserting, exercising, or defending against legal claims.

In such instances, we reserve all rights to raise or waive legal objections or protections as permitted under applicable law.

6.2 Risk Mitigation and Platform Integrity

We may integrate third-party providers to support Platform features—including avatar creation using Biometric Data. These providers are contractually bound to:

• Use Information only to perform specific services on our behalf;
• Comply with strict data security and privacy standards;
• Not retain, share, or use Biometric Data beyond the stated scope of service delivery.

We do not authorize our partners or service providers to independently use or disclose your Information except as necessary to provide these contracted services.

7. Chat Privacy Policy

The FlippX Platform includes a Chat Feature that enables real-time messaging between users. The following terms govern the privacy, use, and ownership of communications made using this feature.

7.1 Data Collected Through the Chat Feature

When using the Chat Feature, we may collect and process the following data:

• Messages and file attachments sent or received;
• Date, time, and other metadata associated with messages;
• Profile information and user identifiers of chat participants.

This data is collected to support the functionality of the Chat Feature and may also be used for system monitoring, abuse prevention, and security enforcement.

7.2 Ownership of Chat Content

You retain ownership of the content ("Chat Materials") you share through the Chat Feature. However, by submitting or sending Chat Materials, you grant FlippX a non-exclusive, worldwide, royalty-free, transferable, and sub-licensable license to use, reproduce, store, publish, and distribute such materials solely for the operation, maintenance, improvement, and security of the chat functionality and related services.

You represent and warrant that:

• You have the legal right to share all content you transmit through the chat;
• Your content does not violate any third-party rights, including intellectual property, confidentiality, privacy, or publicity rights.

7.3 Restrictions and Enforcement

The Chat Feature may not be used to:

• Upload or transmit infringing or illegal content;
• Violate another person's rights or breach contractual or confidentiality obligations;
• Harass, defame, or otherwise harm other users.

Violation of these terms may result in suspension or termination of your access to the Chat Feature, in addition to legal liability.

We reserve the right to:

• Remove or restrict access to any Chat Materials we believe violate our policies or applicable laws;
• Monitor and review chat content, including by our system administrators and service providers, for quality assurance and safety enforcement purposes.

7.4 Confidentiality and Retention

Please be aware that:

• Chat communications on FlippX are not end-to-end encrypted, meaning they may be accessible to authorized personnel for technical support and moderation.
• Sensitive or confidential personal data should not be shared through the Chat Feature.
• Chat Materials will be retained consistent with our internal data retention policies and legal obligations and may be disclosed where legally required.

8. Automated Data Collection / Cookies

We use a variety of automatic tracking technologies to enhance your experience on the FlippX Platform, understand how users interact with our services, and deliver relevant content and advertising. These technologies help us store and manage user preferences, gather Device and Usage Information, analyze trends, and customize features.

The tracking technologies we use include but are not limited to:

Cookies

Cookies are small data files stored on your browser or device. We use cookies to:

• Remember your preferences and login information;
• Personalize content and user experience (e.g., greet you by name);
• Track and analyze usage patterns;
• Deliver customized ads;

• Collect mobile identifiers such as Apple IDFA or Android Ad ID;
• Monitor app usage;

These technologies operate similarly to cookies but are specific to mobile environments. By continuing to use the Platform, you consent to our use of these technologies as described above.

Consent

By visiting or using the FlippX Platform, you acknowledge and agree that we may use these tracking technologies (now and in the future) to analyze your activity, provide personalized content, and deliver tailored advertising. You also agree that similar tracking technologies may be used in our emails.

9. Personal Data Retention

We retain your Personal Data only for as long as necessary to:

• Provide access to and support for the Platform;

However, no method of data transmission or storage can be guaranteed to be 100% secure.

• You are transmitting data at your own risk;
• We cannot be held responsible for third-party access resulting from transmission errors, unauthorized acts, or interception.

If you believe your data is being misused or accessed improperly, please contact us immediately at privacy@getflippx.com so we can investigate and take appropriate action.

11. Children's Privacy -- Minors Under 18

The FlippX Platform is designed for use only by individuals 18 years of age or older. We do not knowingly collect, solicit, or retain Personal Data from anyone under the age of 18.

If you are under 18, you must not use the Platform or provide us with any Personal Data.

If we learn that we have inadvertently collected information from a user under 18, we will delete that data promptly. Parents or legal guardians who believe their child may have submitted Personal Data to us should contact us immediately at privacy@getflippx.com.

12. Targeted Advertising and Analytics

We work with certain trusted third-party partners to deliver advertisements across the Internet and to provide analytics and measurement services. These partners help us understand how users engage with the FlippX Platform, track the performance of marketing campaigns, and deliver personalized advertising that may be more relevant to your interests.

We may also engage in affiliate advertising and may include affiliate links within our Platform. If you click on an affiliate link and make a purchase, we may receive a commission at no extra cost to you.
